PEEBLES DRIVING SCHOOL - TERMS OF BUSINESS
1) Lesson Slots
Lesson slots are generally weekly unless by prior arrangement.
2) Driving Licence
a) Clients must personally ensure that they are the holders of a valid, current driving licence ( provisional or full ) - which must be produced at the first lesson.
b) Clients must inform their instructor if they receive any endorsements on their licence during the time, they are receiving tuition; including any disqualifications.
c) Clients must inform their instructor of any special needs or medical conditions they have that might affect their ability to drive.
3) Eyesight
a) Clients are responsible for ensuring that their eyesight meets the statutory “standards of vision for driving”.
b) On your first lesson your instructor will carry out an eyesight check. You must be able to read a number plate (made after 1 September 2001) from 20 metres otherwise the lesson cannot continue.
4) Tuition Fees
a) Tuition fees are as stated below and are payable in advance or at the end of the lesson. Fees, for using your instructors car, for the official practical driving test must be paid prior to the test.
b) Duration of a standard lesson will be approximately 60 Minutes
c) The charge for a standard lesson is £35. A block of 5 lessons is £165. A block of 10 lessons £325. Pass Plus is £250.
d) The hire of the tuition car and instructor for the driving test is the equivalent of two standard lessons.
e) All fees are subject to adjustment from time to time at 4 weeks’ notice.
f) Payment can be made by cash, cheque or bank transfer.
5) Postponement of a Lesson by the Driving Instructor
a) If by reason of a vehicle failure or other emergency a lesson must be postponed at short notice, an alternative appointment will be made with mutual consent. If the postponement is a driving test, your instructor will be responsible for the test fee, only; if it cannot be cancelled within the statutory time.
b) Driving tests take priority over lessons, therefore, pre-booked lessons may have to be cancelled or postponed if your instructor receives short notice of a driving test appointment for another client.
c) Except as provided for in a) above, your instuctor will give at least 24 hours’ notice, of rearrangement or postponement of a lesson.
6) Postponement or Cancellation of Lessons by Clients
a) At least 24 hours’ notice of postponement or cancellation of a lesson is required. Late cancellations and no shows will be charged at the full cost of the lesson.
7) Postponement or Cancellation of a Practical Test
a) Attention is drawn to the fact that a statutory period of notice is required under government regulations for the cancellation or postponement of a test.
b) If a client has a test booked and their instructor does not believe that they will reach test standard by test date, you will be advised in good time, of the need to cancel the test. Your instructor cannot be responsible for the loss of the test fee if the client fails to notify DVSA within the statutory period.
8) The instructor
a) We guarantee that our instructors are legally authorised, approved driving instructors.
b) Your instructors official authorising badge will be displayed in the windscreen of the car, and may be inspected freely at any time.
9) The Driving Test
a) you will be advised of the appropriate time to make an application for the practical driving test by your instructor. The advice will be based on the client’s progress to date and official test time delay. It does not imply that the necessary standard has been reached, or that it will for certain be reached by the appointed test date, your instructor will not hesitate to advise, where necessary, the postponement of the test. This condition is intended to save the client expense, unnecessary failure, and the consequent delay in waiting for another test and obtaining a full licence.
b) Peebles driving school reserves the right to withhold the use of the training vehicle for the test, if in its opinion the client is - i) Not at driving test pass standard. Or for the test or a lesson, if in my opinion the client is: ii) Medically unfit (including eyesight). iii) Under the influence of drugs or alcohol. iv) Is not properly licensed to drive. v) If, for any other reason, your instructor considers the client will be unsafe to handle a motor vehicle.
c) Clients may be accompanied on their test by any person authorised by the Secretary of State to attend the test for the purpose of supervising it or otherwise
d) Clients are reminded that when they attend for theory or practical test, they must take the required documents. Failure to comply with this regulation may result in the test being cancelled, forfeit your test fee, the need to apply for a new test date and pay the fee again.
e) If a client wishes to use their instructors car for a practical test they must ensure that it is available. Please ask to see the list of dates when it is not available prior to booking.
f) Should a client have their instructors car booked for a test and due to an instructor related, unforeseen emergency, or mechanical failure of said car (both before and during the test) then their liability is limited to the cost of the test.
10) Lessons in Own Car
a) In some circumstances lessons may, by prior arrangement, be given in a client’s own car, on condition that it is clearly understood: i) The car is fully insured for teaching for reward (ie your instructor is being paid to teach) - and this must be confirmed, in writing, by the vehicle underwriters. ii) The instructor is covered by such insurance to drive the car - to be confirmed as above. Iii) Peebles driving school instructors can in no way be held liable for any damage or accident. While we will make every effort to prevent the client having an accident, or damaging the car, it will be realised that my control is very limited. If clients wish to have lessons in their own car then a second rear view mirror must be provided. In view of the extra responsibility entailed, there will normally be no reduction in lesson charges.
11) Insurance
a) Our tuition cars are fully insured for tuition and driving tests.The certificate of insurance is available for inspection. b) No liability of any kind can be accepted for the loss of, or damage to any property belonging to, or in the possession of the client.
12) Legal Liability
a) Clients should be aware that their instructor’s primary objective is to promote road safety, and in doing so, will have to issue instructions which clients must be prepared to carry out without undue argument.
b) Your instructor will make every effort to train you to the highest standard, but can in no way be held liable for any errors you commit whilst driving and not accompanied by me either before a test, during a test or after a test pass.
c) At all times that the client is legally in charge of the vehicle, they will be liable for any fines or charges levied as a result of any motoring offence committed.
13) Complaints
a) If you are unhappy with any aspect of your tuition please notify Peebles Driving School without delay, and not later than seven days from the date on which the cause of the complaint arose. Every effort will be made to satisfactorily deal with the complaint, these “Terms of Business” and the “Code of Practice for Approved Driving Instructors” forming the basis for negotiations.
